Daniel E. Waltz

Mr. Waltz is a partner at the Washington DC law firm of Patton Boggs LLP where he concentrates his practice in international trade and transactions, including compliance with U.S. embargoes of countries such as Cuba, Iran, and Sudan and Syria.  He worked closely with Members of Congress and their staffs in connection with the drafting of and amendments to the Trade Sanctions Reform Act of 2000 that authorized licensed sales of agricultural products from the U.S. to Cuba and lobbied Congress several years later to lift the ban on travel to Cuba. 


He has obtained interpretive rulings from the Office of Foreign Assets Control (OFAC) and routinely prepares license applications to both OFAC and the Commerce Department’s Bureau of Industry and Security (BIS) for a variety of different Cuba-related transactions.  He has assisted clients in negotiating and drafting contracts to sell agricultural products to the Cuban government agency Alimport and advised clients with respect to both legal and commercial issues that have arisen in connection with those sales.  He has prepared export and OFAC compliance programs for a variety of companies and has represented clients before OFAC, BIS and Customs in compliance and enforcement proceedings.  He also advises non-U.S. companies on the substance and applicability of U.S. sanctions, including the U.S. embargo of Cuba, and has represented one company during repeated State Department investigations seeking to determine whether the company is “trafficking” in confiscated Cuban property for purposes of the LIBERTAD Act (also known as Helms-Burton). 

 

More generally, Mr. Waltz routinely counsels clients on export administration issues including the permissibility of proposed exports under the Export Administration Regulations and International Traffic in Arms Regulations.  He assists clients in obtaining licenses, creating compliance programs, and represents clients in both criminal and administrative enforcement proceedings relating to exports.  Mr. Waltz also has extensive expertise relating to import-related issues and customs matters.


In addition to his regulatory work, Mr. Waltz assists clients in the negotiation and drafting of international sales, agency, distributorship, technology transfer, license and transportation agreements.  Mr. Waltz taught International Business Transactions for two years as an Adjunct Professor at the Columbus School of Law at the Catholic University in Washington, DC, has lectured on international legal topics for the International Law Institute and served as the President of the Washington Foreign Law Society.  He was the monthly columnist for the Cuba Trade & Investment News from December 2003 until August, 2005.
